Terms of Service

The plain-language terms for using this site and working with us. Clear, protective, and free of fine-print traps.

1. Acceptance of these terms

This site is operated by Aashapura LLC ("we", "us", "our"). By using this site — browsing it, running the free scan, messaging our assistants, subscribing, or engaging us for work — you agree to these terms. If you do not agree, please do not use the site. If you accept on behalf of an organization, you confirm you have authority to bind it.

2. Description of services

This is our professional site and a way to start a conversation about a project. We provide AI engineering, automation, and web design and development (including design produced through our Design Engine), together with our related product suite — assistants, scanning and analytics tools, and other software. Case studies, scans, articles, and other content are provided for information. Nothing on this site is a binding offer, a promise of specific results, or professional advice for your particular situation.

3. The free scan and tools

Any free scan or interactive tool on this site gives an automated, best-effort assessment. It is a starting point, not a guarantee. We do not warrant that a scan is complete, error-free, or suitable for any specific decision, and you should not rely on it as your only source of truth.

4. Engagements and no guarantee of outcomes

If we decide to work together, the specifics — scope, fees, milestones, timeline, and deliverables — will be set out in a separate written service agreement, which takes precedence over these terms for that work. We bring real care and experience to every engagement, but software and AI systems are complex: we do not and cannot guarantee any particular business outcome, ranking, revenue, performance metric, or result. Any figures, benchmarks, or case-study results shown on this site describe past projects and are not a promise of what you will achieve.

5. Payments and refunds

Where the site offers a paid subscription or service, payments are processed securely by Stripe, and prices and inclusions are described at the point of purchase or in your service agreement. Our billing and refund terms — including our non-refundable deposit and re-work goodwill approach — are set out in our Payment & Refund Policy, which forms part of these terms.

6. Acceptable use

You agree not to:

  • Use the site or services for anything unlawful, infringing, or harmful.
  • Try to break, overload, scrape at scale, or gain unauthorized access to the site or its systems.
  • Submit other people's personal data without their permission, or submit malicious content.
  • Reverse engineer, resell, or misuse our software, tooling, or the product suite.
  • Misrepresent who you are when contacting us.

7. Intellectual property

The design, text, code, case studies, product suite, and our underlying tooling, engines, models, and frameworks (including our Design Engine) are and remain our property or that of our licensors, protected by intellectual property law. We retain all rights in anything we develop, own, or improve independently of a specific engagement, including reusable components and know-how.

For paid engagements, ownership of the specific custom deliverables we create for you is governed by your service agreement — typically, on full payment, you own the bespoke work product delivered to you, while we retain our pre-existing and general-purpose tooling, and keep a license to use non-confidential learnings.

Anything you send us through the site (such as a message or scan input) remains yours; you grant us permission to use it to respond to you and provide what you asked for. Trademarks and product names of others belong to their respective owners.

8. Third-party links and services

This site links to and integrates third-party services (for example, scheduling, payments, and code repositories). We are not responsible for the content, availability, or practices of services we do not control. Your use of them is subject to their own terms.

9. Disclaimers of warranty

The site, its content, and our services are provided "as is" and "as available", without warranties of any kind, whether express or implied — including implied warranties of merchantability, fitness for a particular purpose, and non-infringement — to the fullest extent permitted by law. We do not warrant that the site or services will be uninterrupted, secure, or error-free, or that any content is accurate or up to date.

10. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, punitive, or consequential losses, or for any loss of profit, revenue, business, data, or goodwill, arising from your use of this site or our services, even if advised of the possibility. Our total aggregate liability for any and all claims relating to the site or an engagement is limited to the amount you paid us for the service giving rise to the claim in the twelve months before it arose. Nothing in these terms limits liability that cannot lawfully be limited (such as for fraud or death or personal injury caused by negligence).

11. Indemnification

You agree to indemnify and hold us harmless from reasonable losses, damages, and costs (including reasonable legal fees) arising from your misuse of the site or services, your breach of these terms, or your infringement of any third-party right or applicable law.

12. Termination

You may stop using the site at any time. We may suspend or terminate your access to the site or a service if you breach these terms, misuse the service, or where required to protect the site, other users, or our rights. Termination of a paid engagement is governed by your service agreement and our Payment & Refund Policy. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.

13. Governing law

These terms are governed by the laws of the State of Delaware, United States — the state in which Aashapura LLC is formed (to be confirmed against the entity's registration) — without regard to conflict-of-laws rules. If any part of these terms is found unenforceable, the rest stays in effect.

14. Dispute resolution

We would much rather fix a problem than fight about one. If you have a dispute, contact us first at [email protected] so we can try to resolve it directly and in good faith. If we cannot resolve it within 30 days, the dispute will be settled by binding arbitration administered under the rules of a recognized arbitration body in the State of Delaware, United States, on an individual basis — you and we each waive any right to a jury trial or to participate in a class action — except that either party may seek injunctive relief in court to protect its intellectual property, and except where applicable law gives you a non-waivable right to bring a claim in another forum.

15. Changes to these terms

We may update these terms from time to time. When we do, we will change the effective date above. Continuing to use the site after a change means you accept the updated terms.
